Article 1 – GENERAL PROVISIONS – SCOPE OF APPLICATION
1.1 These General Conditions of Sale (“the GTC”) determine the rights and obligations of the parties in the context of the online sale of Products offered by the company Acaiso (“the Company”).
1.2 Any order placed on the Acaiso website implies prior and unconditional acceptance of these General Terms and Conditions of Sale, which are subject to French law. These General Terms and Conditions of Sale are therefore an integral part of the Contract between the Customer and the Company. They are fully enforceable against the Customer, who declares that they have read and accepted them, without restriction or reservation, before placing the order.
1.3 These General Terms and Conditions apply to any order placed by a natural person of full age acting as a consumer. The Customer therefore certifies that he is a natural person over 18 years of age, acting for purposes that do not fall within the scope of his commercial, industrial, craft, liberal or agricultural activity. He acknowledges having full capacity to commit himself when placing an order and undertakes to provide truthful information regarding his identity.
1.4 EXCLUSION : Persons acting in a professional capacity are expressly excluded from the scope of these General Terms and Conditions. Professionals who wish to place an order with the Company are invited to contact us directly.
1.5 The T&Cs applicable to each order are those in effect on the date of payment or the first payment (in the case of multiple payments) of the order. The Company reserves the right to modify them at any time, by publishing a new version on its website. Article 2 – CONCLUSION OF THE ONLINE CONTRACT
2.1 Order placement process
To purchase one or more Products on the site, the Customer follows the following process:
- Selection of Products and addition to cart.
- Confirmation of the basket (1st click) after verification.
- Reading and validation of the T&Cs (2nd click), which results in an obligation to pay.
- Secure payment via the methods offered.
After validation, the Customer receives a confirmation by e-mail including a summary of the order, the General Terms and Conditions in PDF, and an electronic invoice.
2.2 Cases of refusal to validate the order by the Company
The Company reserves the right to refuse an order for legitimate reasons, such as:
- Non-compliance with the T&Cs.
- Suspicion of fraud.
- Non-payment or ongoing dispute regarding a previous order.
Article 3 - PRODUCT SPECIFICATIONS AND AVAILABILITY
3.1 Product Specifications
The essential characteristics of the goods and their respective prices are available on the Acaiso website. Although the Company ensures that this information is accurate, it may sometimes include errors due to data provided by the manufacturers. The illustrations, photos or videos on the site have no contractual value.
3.2 Availability of Products
Product offers are valid while stocks last. In the event that a product is unavailable after the order has been validated, the Customer will be informed by email. The order will then be cancelled and refunded for the unavailable product, unless the order includes other available products.
Article 4 - PRICE OF PRODUCTS
4.1 Prices indicated on the site
Product prices are displayed in euros, excluding taxes and delivery costs. Any customs duties or local taxes remain the responsibility of the Customer.
4.2 Price changes
Acaiso reserves the right to modify its prices at any time. The products ordered will be invoiced at the price in effect at the time the order is validated.
4.3 Taxes and customs duties
For deliveries outside the European Union, import taxes or customs duties are the sole responsibility of the Customer. These costs are not charged by Acaiso and must be paid directly to the local authorities.
Article 5 - PAYMENT OF THE PRICE OF THE PRODUCTS
5.1 Time of payment
Payment of the full amount is required immediately after validation of the order.
5.2 Accepted payment methods

Bank card : Secure payments by bank card.

PayPal : Accepted up to a limit of €1,000.

Vouchers and promotional codes : Valid for all or part of an order.
In the event of a payment problem, Acaiso reserves the right to cancel the order.
Article 6 - DELIVERY, CUSTOMS CLEARANCE AND RECEIPT
6.1 Delivery
Delivery costs are included in the total amount invoiced, but exclude any customs fees. In the event of a failure to deliver due to incorrect information provided by the Customer, Acaiso cannot be held responsible.
6.2 Customs clearance
For deliveries outside the European Union, the Customer becomes the importer of the products and is solely responsible for customs clearance procedures.
6.3 Reception
The Customer must check the products received within 3 days of receipt. Any anomalies must be reported to customer service within this period.
Article 7 - WITHDRAWAL
7.1 Principle and deadline
The Customer has 30 calendar days from receipt of the order to exercise his right of withdrawal. The return costs remain his responsibility.
7.2 Conditions for exercising the right of withdrawal
The Customer must inform Acaiso of his intention by e- mail to contact@acaiso.com and return the products in their original condition. A refund will be made within 30 days after receipt and inspection of the returned products.
Article 8 - GUARANTEES
8.1 Legal guarantees
Acaiso complies with the legal guarantees of conformity and against hidden defects. The Customer can choose between repair or replacement of the product in the event of a lack of conformity.
8.2 Manufacturer Warranty
Some products benefit from a contractual warranty provided by the manufacturer. The terms are mentioned on the product sheet.
Article 9 - PROTECTION OF PERSONAL DATA
Acaiso collects and processes personal data in accordance with applicable laws, including the GDPR. The Customer has the right to access, rectify and oppose their data. Requests can be sent to contact @acaiso .com .
Article 10 - INTELLECTUAL PROPERTY RIGHTS
All contents of the site (texts, images, logos, etc.) remain the exclusive property of Acaiso or their rights holders. Any unauthorized reproduction is strictly prohibited.
Article 11 - FORCE MAJEURE
Acaiso cannot be held responsible in the event of unforeseeable and irresistible events preventing the execution of its obligations.
Article 12 - EXCLUSION OF LIABILITY
Acaiso cannot be held liable in the event of improper use of the products by the Customer.
Article 13 - SUSPENSION AND TERMINATION OF ACCOUNT
In the event of non-compliance with the T&Cs, Acaiso reserves the right to suspend or terminate a Customer's account.
Article 14 - ARCHIVING AND PROOF
Communications, orders and invoices are archived and stored in secure conditions for a period of 5 years.
Article 15 - NULLITY AND MODIFICATION OF THE GTC
If any clause of the T&Cs is deemed invalid, the other provisions shall remain in force. Acaiso reserves the right to modify its T&Cs at any time.
Article 16 - APPLICABLE LAW AND DISPUTE RESOLUTION
These General Terms and Conditions are subject to French law. In the event of a dispute, the Customer is invited to contact customer service for an amicable resolution. In the absence of an agreement, the Customer may refer the matter to the European Commission's dispute resolution platform via http://ec.europa.eu/consumers/odr .
